CONDITIONS OF SALE 

The owner of the site www.suruq.it aimed at the sale of products online is Appress Srl with its head office in Via dei Santi Coronati 14, 96100 Siracusa SR.

All orders placed through the site are governed by the following terms and conditions of sale.

Appress Srl reserves the right to modify them at any time, therefore the applicable sales conditions shall be those in force at the time the order is placed. By submitting an order you declare that you have read, understood and accepted these sales conditions.

Orders are only accepted with delivery within Italy.

REGISTRATION

In order to place orders, one must be registered and the information the customer enters must be correct, complete and updated in a timely manner in the event of a change of address or other mandatory data.

The password that the customer enters upon registration is strictly personal and confidential and shall not be disclosed to third parties. The customer is responsible for the use of the password and for orders placed through it, even if without the customer's knowledge. If you know or suspect that someone else knows or is using your password, please inform Appress Srl immediately by email at commerciale@suruq.it

By registering, the customer consents to the processing of his or her personal data in accordance with the Personal Data Protection Act No. 675/96 and subsequent updates.

ORDERS

Due to the possibility of multiple purchases by several users at the same time, Appress Srl, once the order has been received, reserves the right to check the availability of the goods and, failing that, to promptly notify the non-acceptance of the order sent.

Orders once transmitted to the system can no longer be modified or blocked, so it is your responsibility to make sure they are correct before confirming them.

For each order placed, a summary email is sent to your inbox. This confirmation message will repeat all the data entered by the customer .

PRICES

The prices indicated for the products displayed include VAT. Shipping costs, however, are not included; they are invoiced on the basis of the rates shown on this site on the date you placed your order. The prices and offers on the site are only valid for online purchases. In-store prices may differ from those shown on the site.

PAYMENTS

We accept payment by bank transfer, credit card and PayPal. Alternatively, we accept payment on delivery (cash on delivery, cash only) with an additional charge indicated on the site when ordering.

DELIVERY OF GOODS

Shipments will be made by express courier, delivery within a maximum of 30 days after the order has been placed, except for goods that are out of stock.

In the event that a product is not available, the consumer will be informed promptly and, if payment has already been made, will be refunded promptly.

Orders will be delivered to the shipping address specified by the customer when placing the order, it is recommended that someone is always present at this address to collect the goods. Please indicate in the notes any information you consider useful to help us with the delivery. However, it is not possible to indicate a precise delivery time, which is at the discretion of the forwarding agent from Monday to Friday during normal business hours.

It is the customer's responsibility to check the quantity and good condition of the goods upon delivery, the number of packages received and their integrity. In the event of obvious damage to the packaging or missing packages, the customer must either reject the goods or accept them by signing the transport document presented by the forwarding agent ''with reservation'' and specifying the damage found.

The consumer undertakes to check without delay, and in any event within and no later than 3 days of receipt of the products, that delivery is in accordance with the order and to inform the seller within that period of any defect in the products received or of their non-conformity with the order placed. Such notification may be made by e-mail to commerciale@suruq.it or by calling +39 0931 1814038.

In the event of missing items in the parcel, they will be returned to you at our expense, once the lack has been ascertained. Alternatively, if they are not available in our warehouse, you will be re-credited for those items.

In the event of a defect or flaw inherent in the product, we shall replace the product at our expense or refund the amount paid.

In any case, the seller's legal guarantee of conformity shall apply pursuant to and for the purposes of European Directive 44/99/EC and Italian Legislative Decree No. 206/2005 (Consumer Code).

LIABILITY FOR DEFECTIVE PRODUCTS

In the event of damage caused by defective products, the provisions of European Directive 85/374/EEC and Italian Legislative Decree No. 206/2005 (Consumer Code) shall apply. Appress Srl, in its capacity as distributor of the products via the website www.suruq.itreleases itself from any liability, none excluded, by indicating the name of the relevant manufacturer.

RIGHT OF WITHDRAWAL

The right of withdrawal only applies to goods undamaged at the time of return.

Pursuant to Legislative Decree 206/2005 (Consumer Code) on distance selling, the consumer has the right to withdraw from the purchase contract for any reason and without explanation. The right is exercised by sending, within 10 working days of receipt of the goods, a written communication by registered letter with acknowledgement of receipt. The communication may also be sent, within the same term, by e-mail to the address info@suruq.it provided it is confirmed within 48 hours by registered letter with return receipt addressed to Appress Srl, Via dei Santi Coronati 14, 96100 Siracusa (SR). This communication must contain a description of the products to be returned, also providing the method of crediting the refund and any bank details. The products subject to withdrawal must be returned at the consumer's expense, undamaged, to the same address. Once we have received the goods and verified their integrity, we will credit the cost of the returned products to the customer, but not the shipping costs incurred by the consumer for the return.

TAX OBLIGATIONS

At national level for online sales via the internet to private customers, there is an exemption from the issuance of an invoice (art 22, paragraph 1, Presidential Decree 633/72), as well as from the certification of receipts (fiscal receipt and receipt) as per art 2 Presidential Decree 696/96. The invoice is only issued if requested by the purchaser at the time of purchase, providing the necessary data (name, surname, address and tax code). In the case of VAT holders, please communicate this when placing the order.

MAJOR FORCE

Appress S.r.l. shall not be liable for delays or non-delivery caused by events beyond its reasonable control, i.e. strikes, wars, natural disasters and courier restrictions and any other events that make the production, transport or delivery of products impracticable.

For anything not specifically mentioned in these conditions, reference is made to Legislative Decree 206/2005 on the protection of consumers in respect of distance contracts.

The Court of Syracuse shall have exclusive jurisdiction over any dispute relating to this contract.
